The Crown Is Yours
As a Corporate Counsel, IP Litigation, you'll take ownership of litigation and intellectual property matters that shape how DraftKings protects its innovations, brands, and business. You'll manage active disputes, advise teams on intellectual property and legal risk, and partner cross-functionally to navigate issues spanning patents, trademarks, copyrights, right of publicity, and emerging technologies. Reporting to the Senior Corporate Counsel, you'll also help advance our artificial intelligence governance framework while proactively identifying and addressing legal risks before they escalate.
What you'll do as a Corporate Counsel, IP Litigation
  • Manage active and potential litigation, including lawsuits, demand letters, and other legal threats, while overseeing outside counsel, litigation holds, e-discovery, document collection, and court filings.
  • Investigate disputes, assess potential legal exposure, develop litigation strategy, and negotiate to resolve matters where appropriate.
  • Advise teams across the business on patent, trademark, copyright, right-of-publicity, and other intellectual property matters while balancing legal risk with business objectives.
  • Support our patent-harvesting program by partnering with employee-inventors, evaluating innovations for potential patentability, and working with outside patent prosecution counsel on patent applications.
  • Protect DraftKings' brands and reputation by managing trademark registration requests and identifying and pursuing infringers, impersonators, and other unauthorized uses across websites, social media platforms, app stores, and other channels.
  • Partner across the organization to proactively identify litigation risks, investigate and respond to regulatory inquiries and customer complaints, and provide practical guidance on day-to-day legal issues.
  • Support the continued development, implementation, and enforcement of artificial intelligence governance policies and guardrails.
  • Serve as a flexible resource across the Legal Team, including supporting commercial litigation, representing the company in small claims matters where needed, and advising on other legal matters as business needs evolve.

What you'll bring
  • A Juris Doctor from an American Bar Association-accredited law school and at least four years of relevant law firm experience.
  • Active membership in good standing with the Massachusetts Bar or the ability to be admitted as in-house counsel in Massachusetts.
  • Substantial experience with intellectual property litigation and related matters involving patents, trademarks, copyrights, name, image and likeness, and right of publicity.
  • Experience managing complex litigation and discovery processes, including developing case strategy and working effectively with outside counsel and cross-functional partners.
  • Strong legal and business judgment with a practical, solutions-oriented approach to assessing risk and resolving complex issues.
  • Strong interpersonal, analytical, and influencing skills, with the ability to translate complex legal issues into clear, actionable guidance for teams across the organization.
  • Excellent written and verbal communication skills, strong attention to detail, and the ability to manage multiple priorities both independently and collaboratively.

The US base salary range for this full-time position is 160,800.00 USD - 201,000.00 USD, plus bonus, equity, and benefits as applicable. Our ranges are determined by role, level, and location. The compensation information displayed on each job posting reflects the range for new hire pay rates for the position across all US locations. Within the range, individual pay is determined by work location and additional factors, including job-related skills, experience, and relevant education or training.
