Director, Global Employment & Immigration Counsel

The Director, Global Employment & Immigration Counsel will be a key member of the Legal team. This role will support Oportun’s People Experience team and business leaders by providing proactive, pragmatic, risk-balanced advice and counsel on employment law matters that touch upon all aspects of the employee life cycle, from recruiting and hiring to termination, in the countries where the Company’s employees are located, currently the U.S., India and Mexico.  This role also manages all employment litigation and dispute resolution and oversees the U.S. immigration program by advising on global mobility issues and supervising the outside immigration legal team in the handling of all U.S. immigration cases. The ideal candidate is a creative and curious thinker who is comfortable with ambiguity and change, seeks input and best practices from others, knows when to escalate issues and seek outside expert help, and collaborates cross-functionally to solve problems.  They will also have unquestionable ethics and integrity, consistently exercise sound legal and business judgment and manage confidential and sensitive information with discretion and professionalism.

 

RESPONSIBILITIES

  • Provide pragmatic day-to-day advice, counsel and support to People Experience teams and business leaders on U.S. employment matters, in particular relating to equal employment opportunity laws (such as Title VII, ADEA, ADA, and their state equivalents), wage and hour, disability accommodation, leaves of absence, paid time off policies, immigration, global mobility, pay equity, contingent workers, and other related areas as needed. Advice and counsel on Mexico, India and other potential global employment issues as needed.
  • Supervise internal Mexico Employment Counsel and provide oversight of litigation management.
  • Advise People Experience on new employment laws, regulations, and legal developments to ensure compliance and to provide strategic guidance in the creation or improvement of existing policies and procedures.
  • Manage the U.S. inbound immigration program and global mobility issues and oversee case handling by outside legal team.
  • Coordinate with and supervise outside counsel where necessary on employment law projects, audits and litigation.
  • Handle pre-litigation negotiations, dispute resolution, and agency charges.  
  • Participate in and influence decision-making processes with internal clients and business leaders.
  • Draft and/or advise on employee-facing documents such as offer letters, employment agreements, including retention and separation agreements, and policies.
  • Partner with People Experience to manage and resolve employee relations concerns and oversee sensitive investigations.

 

REQUIREMENTS

  • J.D degree from an ABA-accredited law school.
  • Active state bar membership in the state in which the candidate works.
  • 8+ years of combined in-house and law firm experience with a strong focus on employment litigation, advising and counseling Human Resources and business teams on compliance with U.S. federal and state employment laws as they apply to a national workforce, including a large multi-state, non-exempt employee population.
  • Experience advising and counseling on Mexico and India labor and employment related matters and managing Mexico labor claims.
  • Solid experience advising on inbound immigration and global mobility matters.
  • Solid experience collaborating with and supervising outside counsel in U.S. employment litigation and arbitration.
  • Strong project management skills.
  • Excellent written, oral and interpersonal communication skills with the ability to distill complex legal concepts into clear, succinct, and pragmatic advice and guidance for HR and business stakeholders while establishing and maintaining trust and relationships.
  • Adept at thriving in a fast-paced environment with shifting priorities, utilizing effective organizational skills to prioritize and manage deadlines for multiple simultaneous projects for multiple stakeholders.
  • Proven track record for collaborating with cross-functional teams (e.g., Human Resources, Finance, IT, InfoSec, Safety & Security, Internal Audit) to set objectives and produce meaningful, measurable results.

 

Preferred Qualifications

  • Experience working with technology and/or fintech companies.
  • Experience working with a U.S. multinational and/or publicly traded company.

 

 

The US base salary range for this full-time position is $158,200 -  $253,100.

Our salary ranges are determined by role, level, and location. The range displayed on each job posting reflects a national minimum and maximum range for new hire salaries for this position. Within this range, individual pay is determined by work location and additional factors, such as job-related skills, experience, and relevant education or training.
