Summary:
The Bankruptcy Analyst II is responsible for ensuring the bankruptcy process is monitored and associated tasks are completed accurately and timely from the time of filing through to release in the servicing platform. The successful candidate for this role is flexible in a fast paced environment, and handles a workload of active bankrupt accounts in Chapters 7, 11, 12, or 13, reviewing debtors’ bankruptcy petitions and schedules, business records, periodic financial reports and any proposed reorganization plan to determine financial viability of the debtor and to make sure Freedom Mortgage is protected. They will be responsible for managing and resolving bankruptcy cases nationwide working to minimize revenue loss by identifying strategies to resolve delinquencies and handle all documentation, legal communication, and notification requirements according to U.S. Bankruptcy Code, investor, and state guidelines in addition to all other applicable laws and regulations. Successful candidates will demonstrate keen attention to detail and the consistent and compliant application of laws, regulations, and internal policies.
Essential Job Duties and Responsibilities include:
Works with outside counsel to investigate and decide on appropriate courses of action, provide additional documentation, draft pencil ledgers, and approve Agreed Orders
Makes decisions on bankrupt accounts based on numerous variables including chapter, delinquency status, and debtor intent while meeting court specified deadlines
Analyzes court documents to determine status of bankruptcy and protect Freedom Mortgage’s interests
Ensures proper calculation of pre and post petition amounts due
Prepares required Proofs of Claims to be filed in the bankruptcy courts
Prepares required Notices of Payment Change
Prepares, sends, and follows up on reaffirmation agreements
Reconciles pre petition and post petition payments and balances
Performs periodic audits of customer charges and payments
Daily maintenance on bankrupt loans in the servicing platform ensuring correct status
Daily maintenance in bankruptcy software (PACER, BANKO, etc) to ensure proper follow-up on case status and document filing
Daily record retention
Reconciles trustee checks
Loads case information into the system of record
Remains current with bankruptcy laws as well as state and investor guidelines to best protect the interests of Freedom Mortgage
Ensures compliance with internal policies and controls, investor guidelines, and governmental regulations
Works with outside counsel, debtors, and debtor attorneys negotiating alternative payment schedules for delinquent accounts, coordinating loss mitigation efforts, or reaffirmation agreements
Compliance with Fair Debt Collection Practices Act (FDCPA)
Works in collaboration and partnership with other team members
Demonstrates in-depth knowledge of all bankruptcy chapters
Oversees department specific projects
Work with management to develop and implement new or revised processes and guidelines and realize process efficiencies and potential gaps created within Default Reporting department
Maintain regular and punctual attendance.

Qualifications:

Education and/or Experience:
High School diploma or equivalent required; three to five years of bankruptcy case management experience; Possess the ability to work independently as a team player and adapt to a fluid work environment with changing regulations and processes. Detail oriented, excellent problem solving and organization skills. Working knowledge of Outlook, Word, Excel and Adobe Professional
Language Skills:
Possess the ability to read, analyze, and comprehend instructions, correspondence, memos, and work place policies. Ability to analyze, interpret general business periodicals, professional journals, procedures and governmental regulations. Possess the ability to write reports and professional correspondences and speak effectively with other employees and/or customers. Present formal information in one-on-one and small group situations to customers and employees and respond to questions from groups of administrators, managers, employees, customers and/or the general public.
Mathematical Skills:
Possess the ability to work with mathematical concepts such as probability and statistical inference, and fundamentals of plane and solid geometry and trigonometry as well as apply concepts such as fractions, percentages, ratios, and proportions to practical situations.
Reasoning Ability:
Ability to solve practical problems and deal with a variety of concrete variables in situations where only limited standardization exists. Ability to interpret a variety of instructions furnished in written, oral, diagram, or schedule form.
